AnswerdamRx. If the judge is so foolish as to actually proceed with this farce, it
will become known to us then. Or its done, the criminals
administering 'justice' will have come to their senses, and peace will break out. Don't hold your 'collective' breaths, herb folks.
The nazi scum who call the shots in this garrison town are not likely to suddenly become respectful of state law. Bullies
NEVER give up without a fight. Lets take the fight to them, ok herb warriors? In the courtroom, we must comport ourselves as herb diplomats, however. Cool?
There are two things we need to consider, first, among ourselves. Racism, and compassion.
Both are wrapped up in Mr. Jackson's defense. The compassion part is this: no matter what the government says, there is without question, abuse of patients and caregivers here in New Berlin. Jovan and his folks are all guilty of being compassionate .
His collective is made up of all races,
men and women of conscience. We have not seen such diversity in the medical cannabis
world since the demise of the NATIVE SUN DISPENSARY. The NSD herb martyrs were incarcerated (and
bankrupted), as a result of 12/12/2005 and 7/6/06 New Berlin police robberies (aka dispensary
raids).
Jovan, a black man, is the only one from AnswerdamRx being charged. A black man
from NSD was persecuted (aka prosecuted), as was one white man. Both men did time in
jail as a result. Why do we belabor the race issue at all? Why do we bring up previous herb raids
in this discussion?
Because Mr. Jackson is going to bring up race, as it were, as
part of his defense. He may be correct. There indeed may be racism involved in this manufactured case. We don't
know, really.
Yet if he wins, only on the grounds of proven police/DA
bias, then what does this mean?
The fact is, race has nothing to do with
our movement, as far as we can see. The real defense, which applies to all of us in the medical
cannabis movement in California is, we are doing nothing wrong.
We are trying
to the best of our 'collective' abilities, to follow state law. We can't let ourselves be distracted
by the race card. We just want to get on with ensuring safe access for all.

2010-02-03 HerbFolks.org Both state and federal cases heard
this week in New Berlin went badly. Really sideways.... James Stacy was essentially told by the judge hearing his case, the edicts issued from Washington,
that the feds will henceforth 'stop intruding in states medical cannabis rights', have no bearing on his case. In typical legalese fashion,
the judge said James is screwed. The grand proclaimations issued at the start of Obuma's tenure in early early 2009, 'does not have the force
of law', and in
his federal courtroom its just as if those words were never uttered by AG Holder. In Eugene's state case, his judge said he has to turn over
his patient records, as Mr. Davidovich is making a claim that he ran a collective, as part of his defense. There was some discussion of HIPPA and
how it might relate to the case, but it seemed to us the judge just blew that concept off entirely as if HIPPA does
not protect medical herb patients, just everybody else in the country. Total and utter bs; both cases are a
waste of taxpayer money. Both cases are examples of OUR government pretending we have rights, then going about their business as usual. Medical
Herb patients are at the mercy of the doctors, lawyers, and ultimately the drug companies, regardless of laws on the books in 14 states. We need
to create new ways to defend ourselves, and shift from being on the defensive, to offense. We need to attack them vigorously,
legally, morally, every way possible until they back down and respect state law. Cool?

Diego City Medical Marijuana Task Farce Chief Solis and
Captain McDonald graced the meeting with their presence, and as expected, trashed the whole concept of medical cannabis, resisting all the way. They attempt to write law... While both claimed they follow the AG Guidelines, their interpretations were rather stupid. They objected to anyone with a recommendation being able to join a collective making MMJ too available to non MMJ interests. This is practicing medicine without a license. And they objected to whatever documentation provided "proving" non-profit status. Not
enough documentation, they said. This is practicing law without a license. Hogwash. These are more delaying tactics, while they plan the next set of raids to deny safe access. Time for debate is over.

public safety union umbrella organization, an interesting move given that Dumanis

on the Front lines! Subject: Hey it's joe nunes u can forward this
I don't want to comment on the details of the case because I haven't been sentenced
yet. I'll be more than happy to lay out many
of the details people have no clue about after my sentencing on 3/22/10. If I'm in prison I will still comment. What I will say is that I plead guilty to manufacture of 25 marijuana plants (3" tall
clones found in the cooperative), money laundering (using cooperative revenue to pay cooperative
bills), and maintaining a drug premises (the cooperative itself). This guilty plea comes
as a result of not being able to use a medical marijuana defense in federal court. My case was federal because of an additional 89 clones (3" tall marijuana plants) found in the back of
someone's car outside another cooperative I was involved with during the raid.
Those 89 plants combined with the 25 found inside the cooperative I was arrested in exceeded the federal
5-year minimum mandatory threshold of 99 plants. My name was on the lease of both cooperatives. I am not being charged for the cultivation of the additional 89 plants now but nevertheless
my case stayed federal. Both cooperatives were incorporated mutual benefit non-profit organizations
in compliance with state law. PS: *editors note...The "person" most responsible for terrorism is San Diego District Attorney
Bonnie Dumanis. She is up for re-election in June and no one is running against her. Does anybody in this garrison town have the will or
the skill to run? Anybody?

law enforcement agencies, cities’ attorneys, and staff. Although the flier sent out by HARM advertised that anyone who cares about the issue was welcome to
attend, all community members who tried to RSVP for the event were turned down. The seminar, held under the guise of “education”, was intended to teach
cities and law enforcement agencies what loop holes exist in the law that they can exploit and what some other counties have
done to ban ‘dispensaries’ outright. Although the City of San Diego has created a task force to provide clarification on regulating medical cannabis
dispensing collectives and cooperatives, HARM instead of working with City Council, or providing support for the recovery
community as the funds they use are intended for, is spending taxpayers’ money on a seminar where they teach county
and city employees on how to undermine Proposition 215. The community did not appreciate this propagandist, misinformation seminar, nor the misappropriation
of our taxpayers dollars that went to pay for law enforcement, city attorney’s and their staff to attend the event. Outside
several dozen protesters gathered with signs to protest. They chanted, marched and sent a strong message that this will not

Courthouse. WHEN: December 7th, 2009 WHY: Hearing in medical marijuana patient Donna Lambert's case (#ACL004). Background: Ms. Lambert is one of 14 people arrested in
the District Attorney-led "Operation GreenRx", which is estimated to have already cost taxpayers over $2 million.
As part of that operation, as many as ten detectives spent six months becoming qualified medical marijuana patients on
fraudulent grounds and then joining medical marijuana collectives. Undercover San Diego Police Detective
Scott Henderson lied to a doctor to obtain a valid medical marijuana recommendation and then reached out to Ms.
Lambert for help. After verifying his valid doctor's recommendation and providing him with medicinal marijuana, Ms. Lambert
now faces seven felony counts. Ms. Lambert's case is important for several reasons. It is one of the first cases to be tried after both President
Obama and US Attorney General Holder have said it was a waste of resources to spend money undermining the state medical marijuana
laws. It is also one of the first medical marijuana cases to be tried since the US Supreme Court refused to hear San

City's permitted more medical marijuana businesses than

to re-start its Medical Marijuana Task Force. Originally formed in 2001, the task force developed guidelines on what amount
of pot a medical marijuana user could have on hand, and was then disbanded-despite a huge jump in dispensaries in San Diego in 2005 and
calls for the city to hammer out guidelines for dispensary operations. With the Supreme Court deciding not to hear San Diego County's challenge
to Prop. 215 (the voter-approved initiative that allows people with a doctor's recommendation to use marijuana for medical
purposes) and Obama saying that raiding medical marijuana dispensaries wasn't going to be a priority for the DEA, medical-marijuana-related
businesses are back. The city seems to think that only eight of these businesses are legit. According to a July 21 memo from Development
Services Director Kelly Broughton, only eight medical marijuana businesses have applied for a city-issued business-tax certificate. The reality is that dozens have applied
for, and been issued, a license-just not under the proper category. Why? Because the city doesn't have the proper category.
Sure, it has a category called "medical marijuana dispensaries," but labeling yourself as such is asking for trouble-dispensaries
are illegal according to guidelines put out by the state Attorney
General. Medical marijuana can be distributed through nonproft co-ops and collectives, the A.G. said, and, so, that's what
medical-marijuana-distribution businesses have been calling themselves. They've also been applying for a business-tax license
under the same categories that dispensaries, collectives and co-ops have historically used. I looked through a year's worth
of business-tax records and here are some of those categories: * Other misc. store/retailers * All other health and personal care * Other direct selling establishment * Holistic health practitioners * Food and health supplement store *
Other individual family services According to Broughton's memo, it's up to Development Services to "determine the appropriate use category"
for each business that applies for a tax license. This determination is "based on information provided by the applicant."
If that's true, then it's surprising that "San Diego Medical Cannabis Collective" (which applied, and received,
a tax license under "Other misc. stores/retailers") didn't get recategorized. Others are less clear, but not by
much: The Green Door Collective (where you can get a contact high simply by standing across the street), the Medicine Man
Herbal House of Healing, Island Herbal Collective and Green Kross Collective. Did any of these names raise a red flag for
Broughton's staff? Who knows. As the U-T's Helen Gao points out, nobody from Development Services
was at today's City Council meeting to answer questions. If you look through the city's business-tax records, using the words "collective," "cannabis"
or "caregivers" as search terms, there are no less than 20 medical-marijuana businesses that have been issues a
business-tax license in the last year. CalNORML lists at least another dozen-and
notice how they're no longer using the term "dispensary," either. Since it's illegal for any business that sells or distributes
medical marijuana to make a profit, the next step is to check these businesses against the California Secretary of State's
business records. Perhaps that'll be one of the task-force's recommendations, unless a reporter with time on his/her hands
gets around to it first.

Monday July 27, 2009More on San Diego's Medical Marijuana Imbroglio Trying
to understand which jurisdiction is responsible for what, & how politicians & prosecutors can get away with construing
the law however they please, is very tricky. Federally, Cannabis is a schedule 1 narcotic according to In California, voters passed Proposition 215 in 1996, which grants
legal marijuana use with a state licensed Physician's recommendation. Then in 2003, legislation passed Senate
Bill 420, which was intended to help clear up Prop 215 & help establish a way for law enforcement to recognize
who is a patient & who is not. In 2008, Jerry Brown, California's Attorney General issued Suggested Guidelines
for medical marijuana patients & law enforcement. Even with all these laws in place, & the Obama
administration claiming that they will not spend federal resources fighting this, San Diego officials have not
stopped! There are moratoriums in El Cajon, La Mesa, Chula Vista, Santee, Escondido, & Oceanside.
The San Diego County Board of Supervisors, who oversee the unincorporated areas, have implemented the state's most
expensive voluntary card program, mandated by SB 420, after they tried to fight the mandate, taking the case
all the way up to the Supreme Court, where it was rejected meaning the California ruling stands: Follow
State law over Federal. The Board is now drafting an ordinance to prohibit illegal medical marijuana
dispensaries in the unincorporated area. Ordinance action being heard on Friday, July 31ST @ 9AM@ Registry
of Voters on Ruffin Road. Meanwhile, the City Council is thinking of re-implementing the Cannabis
Patients' Task Force & possibly more moratoriums. Patients are encouraged to attend the Public
Health & Safety Committee on Wednesday, July 29th @ 2PM @ the City Council building. The District Attorney is
prosecuting medical marijuana providers in San Diego & has even reportedly launched a new investigation targeting medical

13 2009 Brother Eugene's story continues: The preliminary hearing in my case lasted today from 8:15 in
the morning until almost 4:30 in the afternoon. After trying to navigate the "Serpentine Roadmap" that makes up
our medical marijuana laws with my attorney in court, it appears to be more confusing then ever. The day started with
the prosecutor fighting tooth and nail to not allow the recommendation from my physician to be admitted into the court records
proving that I am a qualified patient even though we had subpoenaed the documentation from the doctor's office, and had a
sworn affidavit to support that from the doctor's custodian of record. My recommendation was admitted although it took a lot
of effort from my attorney. The expert witness Chris Conrad, did get to testify and testified that the collective and
the way that it was operating was in fact legal and sanctioned under state law Even though the expert witness who was originally
involved in an advisory and consulting capacity in drafting Prop 215 testified to what a collective is and that what I was
doing did in fact fall under that definition as intended by the law, the judge did not agree he saw ‘no evidence of
a collective" even though the detectives themselves said that I cultivated marijuana based on the equipment they found
in my storage unit. We also found out from Detective Conrado Decastro that thisOperation Green Rx was in fact
targeting Medical Marijuana Patients and the whole point with Operation Green Rx was to bring down everyone listing their
collectives on NORML only later was the name changed to Operation Endless Summer. We also found out that Conrado
Decastro is in charge and is the ‘mastermind' behind "Operation Green Rx". On a side note: In February
when I was arrested, Conrado Decastro interrogated me at the police station. During the interrogation he pulled
out two large 3 inch black binders that had a large red cross and marijuana leaf on them. The two binders contained a large
number of tabs with last names of people. As he pulled out the two binders, he told me that I was not alone, and that "we
are gonna bring all you medical pot people down".
Detective Scott
Henderson (Jamie Conlan) today, conveniently ‘could not recall' the details of the two phone conversations we had where
I explained to him that this was a collective cultivation effort, and that he was not to divert the medicine to the illicit
market. It was also very convenient that the detectives recorded everything except for the phone conversations even though
he testified that the equipment for such recordings was readily available. It was unbelievable to see this much resources
from the practically bankrupt county of San Diego being spent on this effort. Today for example, there were at least 5 bailiffs
in the courtroom, the DA had at least five other people from the DA's office advising her on how to properly prosecute this
case, and they brought out three detectives to testify. All this during a Preliminary Hearing for a case where both people
are qualified medical cannabis patients. It seems that the San Diego Narcotics Division TOP priority has been made to
investigate and shut down medical cannabis collectives in San Diego. I am still in shock after today and am now trying
to figure out how to get funds together for my attorney to retain him further. It seems that the DA is heavily invested
into this ‘war' and it seems that I just might end up being another ‘casualty' as fighting this machine seems
almost impossible, especially when they have unlimited disposal to their attorneys and ‘advisors' and I have to rely
on my self, a public defender, or somehow attempt to afford an attorney after loosing my employment and savings as a result
of these charges. In short, it went as expected. The bias shined bright in court today! Thank you again to everyone
who came and supported me in court today. It was truly inspiring to turn around and see a packed courtroom in the morning
as well as to get to speak with a number of you. As more collectives open here in San Diego, it is now more critical
then ever for patients from the Medical Cannabis Community in San Diego to stand together against this continued attempt to

REGION: County's case against medical marijuana hits dead endSupervisors may issue ID cards as Supreme Court denies appealBy EDWARD SIFUENTES - esifuentes@nctimes.com | Monday, May 18, 2009 6:20 PM PDT ∞ The San Diego County Board of Supervisors' case against medical marijuana reached a legal dead-end
Monday.
The U.S. Supreme Court declined to hear an appeal from San Diego and San Bernardino counties, which sought
a ruling on whether California's medical marijuana law trumps the federal controlled-substances law banning the drug's use.
In reaction to the court's decision, the county's lead attorney said he will recommend the board approve giving the
ID cards to patients at its meeting on June 16.
"We are obviously disappointed; we thought that this was a
good vehicle to resolve the conflict" between the state and federal laws, said attorney Tom Bunton, who represented San
Diego County. "This is pretty much the end of the game."
Oceanside City Attorney John Mullen said the
court's decision would have no effect on the city's 45-day moratorium on medical marijuana dispensaries approved last week
by the City Council.
Mullen said the city's moratorium is a "zoning issue" and not a question on the
legality of medical marijuana.
Supporters of medical marijuana said they were pleased with the U.S. Supreme Court's
decision.
"We are glad to see that the court has agreed with our position," said David Blair-Loy, legal
director with the San Diego American Civil Liberties Union. "Now we fully expect them (the county) to comply with the
law."
The ACLU represented the San Diego chapter of NORML, the National Organization for the Reform of Marijuana
Laws, in the case. NORML is a defendant in the county's suit.
The county has suffered several defeats since it
filed the case in 2006.
Attorneys for the county argued that the federal law making it illegal to use marijuana
supersedes Proposition 215, the 1996 ballot state measure that legalized marijuana for patients with a prescription.
In July, California's 4th District Court of Appeal rejected the county's contention that the state law flies in the face
of federal pot prohibitions.
The appellate court ruled state law does not "pose a significant impediment"
to the federal Controlled Substances Act because that law is designed to "combat recreational drug use, not to regulate
a state's medical practices."
In October, the California Supreme Court rejected the county's request to review
the ruling. That left the county with the option of asking the nation's highest court to step in. That door closed on Monday.
Supervisor Bill Horn, whose district includes much of North County, said in a phone interview that he still believes
the decision was wrong, but acknowledged that the case is now over.
"I think there's no justification whatsoever
defying the state court's ruling if the Supreme Court won't hear it," Horn said. "I still think it's wrong. I think
federal law trumps the state law."
In 2005, Horn was among three supervisors who voted to oppose a state law
requiring counties to create medical marijuana registries and issue identification cards to patients. The law, Senate Bill
420, was supposed to make it easier for law enforcement officials to identify legitimate patients.
The board's
majority, Supervisors Horn, Dianne Jacob and Pam Slater-Price, said at the time that complying with the state's order would
tell children that marijuana was OK and lead to increased drug abuse.
Since 2005, the county district attorney's
office has adopted the supervisors' aggressive stance toward the law. Local law enforcement officials have helped federal
drug enforcement officials crack down on, and essentially shut down, local medical marijuana dispensaries.
Slater-Price
repeated her concerns about the message medical marijuana sends to kids, but the supervisor said that she likely would support
the county attorney recommendation to issue the ID cards.
"This increases the responsibility on teachers and
parents, because it's going to take away one of their main weapons: that the drug was illegal," Slater-Price said Monday.
"At least maybe it will open a dialogue and parents will talk to their kids."
Jacob said in a written
statement that she was disappointed by the court's decision. She declined to say whether she would support issuing the ID
cards.
"We were seeking a definitive ruling, in writing, that would resolve the conflict between state and
federal law," Jacob said. "In my opinion, there remains a gray area that will continue to pose challenges for law
enforcement and users."
Medical marijuana patient Rudy Reyes, 31, said Monday that the county must follow
state law and begin issuing ID cards.
"The people voted for this law," he said. "A lot of people
in San Diego have waited 13 years for this."
Reyes, of Santee, uses marijuana to alleviate the pain of third-degree
burns suffered during the 2003 Cedar fire.
If the supervisors follow through and issued ID cards to patients, Reyes
said he will no longer feel like a criminal and fear prosecution.
"It will improve my life," Reyes said.

(post date) A local lady wrote in about another recent situation, contrasting it with the horrific crimes being perpetrated by the SD District Attorney
against medical cannabis caregivers, who were just delivering to the sick.
Oscar worked at a pipe shop in PB and gave away samples of marijuana along with his phone number and told the narc that he would sell marijuana to them.
I see no evidence of any attempts made by the police to purchase marijuana etc. He was originally charged with two felonys and two misdemeanors, then allowed
to plead guilty to misdemeanor charges. This is an example of the Endless Summer/Nightmare sting,
being focused and and prosecuted more harshly than medical cannabis providers.
* editors note: why is this person allowed to walk away with a misdemeanor charge while honorable medical cannabis caregivers, who obey the law, get charged with felonies?
